By accessing or using the website at masonrypalmcoast.com (the "Site"), or by engaging Palm Coast Concrete & Masonry for any masonry or concrete service, you agree to these Terms and Conditions in full. If you do not agree, please do not use the Site or request services from us. These terms apply to all visitors to the Site and to all clients who enter into a service agreement with Palm Coast Concrete & Masonry.
Palm Coast Concrete & Masonry provides masonry and concrete contracting services in Palm Coast, FL and surrounding communities, including but not limited to:
The scope of any specific project is defined in the written estimate or proposal provided to the client. Services not described in a written agreement are not included.
Written estimates provided by Palm Coast Concrete & Masonry are based on the information available at the time of the on-site assessment. Estimates are valid for 30 days from the date of issue unless otherwise noted.
Estimates may be revised if conditions discovered during the course of work differ materially from those observed during the initial assessment. We will notify you of any change before proceeding with additional work.
Verbal quotes or rough estimates provided over the phone are not binding. Only written, signed proposals constitute a formal service agreement. All prices are in U.S. dollars.
Project scheduling is confirmed upon receipt of any required deposit and written acceptance of the estimate. We will provide a start date and estimated completion timeframe. Timelines may be affected by weather conditions, permit processing times, or factors outside our control.
If you need to cancel or reschedule, please contact us as early as possible. Cancellations made after work has begun or after materials have been ordered and delivered may be subject to costs for materials procured and labor already performed.
Palm Coast Concrete & Masonry reserves the right to reschedule or suspend work due to unsafe conditions, weather, or circumstances beyond our reasonable control. We will communicate any such changes to you promptly.
Payment terms are specified in your written estimate or service agreement. In general, a deposit may be required to secure your project start date. Final payment is due upon completion of work and your acceptance of the finished project.
Payments are accepted by the methods described in your written agreement. If payment is not received within the agreed time, Palm Coast Concrete & Masonry reserves the right to stop work and pursue any outstanding balance through available legal means, including the filing of a mechanic's lien on the property where the work was performed, as permitted under Florida law.
Any disputes regarding payment must be raised in writing within 5 business days of invoice receipt. Disputes do not excuse the timely payment of undisputed amounts.
Palm Coast Concrete & Masonry warrants that all work will be performed in a workmanlike manner and in accordance with applicable building codes. Any specific warranty terms - including duration and coverage - will be stated in your written service agreement.
Warranties do not cover damage caused by events outside the scope of the original repair or installation, including but not limited to flooding, ground movement unrelated to our work, improper use, modifications made by others, or normal weathering and wear over time.
The Site and all information on it are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of harmful components.
To the fullest extent permitted by law, Palm Coast Concrete & Masonry's total liability to you for any claim arising from services performed or from your use of the Site will not exceed the amount you paid us for the specific service giving rise to the claim.
In no event will Palm Coast Concrete & Masonry be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or property damage not directly caused by our work, even if we were advised of the possibility of such damages.
You agree to provide us with accurate information about the property and any known conditions that could affect the work. This includes existing underground utilities, prior repairs, structural concerns, or access restrictions.
You are responsible for ensuring that the work area is reasonably accessible and that any required permits or homeowner association approvals not handled by us have been obtained. Delays caused by inaccessibility or missing approvals may affect project timelines and costs.
All content on the Site, including text, images, graphics, and design, is the property of Palm Coast Concrete & Masonry or its content providers and is protected under applicable copyright and intellectual property laws. You may not reproduce, distribute, or use Site content for commercial purposes without our express written consent.
If a dispute arises between you and Palm Coast Concrete & Masonry, we encourage you to contact us first so we can try to resolve it directly. Most issues can be handled quickly with a conversation.
If direct resolution is not possible, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association, with proceedings held in Palm Coast, Florida. Each party is responsible for its own legal costs unless the arbitrator awards otherwise. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against us.
These Terms and Conditions are governed by and interpreted under the laws of the State of Florida, without regard to conflict of law principles. Any legal proceedings not subject to arbitration will be brought exclusively in the state or federal courts located in Florida.
We may update these Terms and Conditions at any time. When we do, we will revise the effective date at the top of this page. Continued use of the Site after any changes constitutes your acceptance of the updated terms. If you are an active client with work in progress, changes to these terms will not affect the terms of your existing written service agreement.
